1. Definitions

These general terms and conditions (hereinafter, the "Terms") comprehensively govern all interactions and services offered, provided or carried out from the website genesisramirez.com (hereinafter, the "Website"), owned by Génesis Altagracia Ramírez Almonte, with DNI 79169914G, domiciled at Calle Cristal 3, Riviera del Sol, 29649 Mijas, Málaga, Spain, and contact telephone +34 625 027 427 (hereinafter, the "OWNER" or "GÉNESIS RAMÍREZ").

These Terms may be modified by the OWNER at any time, informing the user of the existence of any new version containing substantial changes by publishing it on the Website.

This document (as well as all other documents referred to herein) governs the terms under which the Website is used and information about the professional interior design services and related services offered by the OWNER through it may be requested.

In addition to reading these Terms, before accessing, browsing and/or using this Website, the user must have read the Legal Notice, the Cookie Policy and the Privacy and Data Protection Policy.

By using this Website or by requesting information about the services through it, the user agrees to be bound by these Terms and by everything mentioned above. If you do not agree, you must not use this Website.

The user is also informed that these Terms may be modified. The user is responsible for reviewing them each time they access, browse and/or use the Website, since the Terms in force at the time the user requests information or interacts with the Website will apply.

Access to, browsing and use of the Website confers the status of user, and therefore, from the moment browsing begins, all the Terms established herein are accepted, as well as any subsequent modifications thereto, without prejudice to the application of the corresponding mandatory legal regulations as applicable.

The user assumes responsibility for making correct use of the Website. This responsibility extends, among other things, to:

  • Using the Website only to make legally valid enquiries and requests for information.
  • Not making any false or fraudulent requests.
  • Providing truthful and lawful contact details, such as email address, postal address and other necessary data.

The user declares that they are over 18 years of age and have sufficient legal capacity to enter into contracts through this Website.

The Website is mainly aimed at users residing in Spain. The OWNER does not guarantee that the Website fully or partially complies with the laws of other countries. If professional services are actually engaged, specific terms may be set out in a specific contract or agreement between the parties, which will prevail over these Terms to the extent that they are incompatible with them.

5. Purpose

These Terms are intended to govern:

  • The conditions under which the user may request information about the professional interior design services and related services offered by the OWNER.

Use of the Website does not in itself imply the actual engagement of professional services, which will be subject, where applicable, to the formalisation of a specific agreement between the OWNER and the user/client.

6. Access and use conditions

Access to the OWNER’s Website is free and open, granting the status of user to whoever accesses it, regardless of any subsequent use of the services offered.

Requests for information about the OWNER’s professional services through the Website may only be made by users over eighteen (18) years of age, who must follow the steps and instructions accompanying the whole process, consisting, by way of example only, of:

  • Completing the contact form available on the Website, providing truthful and up-to-date data.
  • Accepting these Terms and the Privacy Policy, which entails the reading, understanding and irrevocable acceptance of each and every one of the Terms, as well as, where applicable, any specific applicable terms.

The user agrees not to use the Website for unlawful purposes or purposes contrary to good faith and public order, nor in a way that could damage, disable or overload the Website, or that could prevent its normal use by other users.

7. Requests through the website

This communication does not in any case imply acceptance of a professional engagement, but only confirmation of receipt.

Requests may be made 365 days a year, 24 hours a day, except when the service is suspended for maintenance of the Website or due to other technical circumstances and/or force majeure.

The actual provision of the OWNER’s professional services will always be subject to the formalisation of a specific contract or agreement between the parties, setting out the applicable specific terms and conditions (scope of services, fees, deadlines, payment terms, assignment of exploitation rights, etc.).

8. Intellectual property

The OWNER retains all intellectual and industrial property rights (including, by way of example, copyright, trademarks, trade names, logos, designs, photographs, texts, illustrations, sketches, models, audiovisual content, as well as the structure and design of the Website) over all the contents of the Website, unless expressly stated otherwise or a written agreement to the contrary exists between the parties.

The user may not copy, reproduce, distribute, publicly communicate, transform, extract, reuse, forward or make available to third parties any of the content subject to the OWNER’s intellectual or industrial property rights without the OWNER’s prior written permission.

Unauthorised use of such content may give rise to the exercise of the relevant legal actions and, where applicable, to the liabilities arising from such use.

They shall under no circumstances give rise to a right to compensation and/or termination of agreements, unless expressly established otherwise in a specific contract with the client.

Minor changes may be made without the need for individual notification, publication on the Website being sufficient.

15. Applicable law and jurisdiction

For any matters that may arise in relation to the interpretation, application and performance of these Terms, the parties expressly submit, waiving any other jurisdiction that may apply to them, to the Courts and Tribunals of the city of the OWNER’s domicile (currently, Málaga, Spain), unless mandatory consumer protection regulations provide for a different jurisdiction.
